Terms of Use

These Terms of Use ("Terms") govern your use of the mobile game Block Munch (the "Game"), provided by Gamelight GmbH (Loyalty Apps), Mönkedamm 11, 20457 Hamburg, Germany ("we," "us," or "our"). By installing or playing the Game you agree to these Terms. If you do not agree, please do not use the Game.

Our Privacy Policy explains how we handle information when you play.

1. Who Can Play

The Game is intended for an adult audience. If you are under the age of majority where you live, you may only use the Game, and in particular make purchases, with the consent of a parent or legal guardian. You must not use the Game if you are under 13 (or the minimum age required in your country).

2. Your License to Play

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Game on devices you own or control, for your private, non-commercial use. All rights in the Game, including its software, art, characters, sounds, names and levels, remain with us and our licensors.

You may not copy, modify, reverse engineer, decompile or redistribute the Game, use cheats, bots, modified clients or automation, exploit bugs, or interfere with the Game, its servers or other players.

3. Virtual Items and Currency

The Game contains virtual items such as coins, boosters, hearts, tokens, sticker packs and other in-game content ("Virtual Items").

  • Virtual Items have no real-world monetary value, cannot be exchanged for money or anything of value outside the Game, and cannot be sold, traded or transferred.
  • You receive a license to use Virtual Items within the Game; you do not own them.
  • We may change, balance, rename or remove Virtual Items and game features, for example to keep the Game fair and fun.
  • Virtual Items are stored with your game progress and may be lost if you uninstall the Game, reset your device or lose access to it, unless they can be restored from the store you purchased them from.

4. Purchases

Purchases in the Game are processed by Google Play (or the Apple App Store on iOS). Prices are shown in the Game and in the store before you buy, including applicable taxes. The store's terms and payment conditions apply to your purchase.

  • Refunds are handled by the store according to its policies, except where the law gives you other rights.
  • Right of withdrawal (EU/EEA and UK consumers): Virtual Items and premium content are digital content supplied immediately after purchase. By completing a purchase you request immediate supply and acknowledge that your right of withdrawal ends once the supply has started.
  • Random rewards: some items, such as sticker packs or mystery boxes, contain randomly selected rewards. The odds for each item are shown in the Game before you open or buy it.

5. Subscriptions (Munch Pro)

Munch Pro is an optional weekly subscription. Its current benefits are described in the Game (for example: no ad breaks between levels, a daily gift and extra hearts). Optional rewarded videos remain available to subscribers.

  • The subscription renews automatically each week at the price shown, unless you cancel at least 24 hours before the end of the current period.
  • If a free trial is offered, the subscription starts at the end of the trial unless you cancel during it.
  • You can manage or cancel your subscription at any time in your Google Play (or App Store) account settings. Uninstalling the Game does not cancel it.
  • If you cancel, your benefits continue until the end of the paid period.

6. Advertising

The Game is supported by advertising. Ads are provided by third parties and may link to their websites or apps, which we do not control. Some rewards are available for watching an optional video ad.

7. Player Content

You can choose a display name, an optional profile photo, and a team name, which other players can see on leaderboards and in teams ("Player Content").

You must not post Player Content that:

  • is sexual, violent, hateful, discriminatory, harassing, threatening or otherwise offensive;
  • shows or names another person without their permission, or contains personal information such as phone numbers or addresses;
  • impersonates another person, us, or our staff;
  • infringes anyone's copyright, trademark or other rights;
  • advertises, spams, or is unlawful.

You keep the rights in your Player Content and give us a free, worldwide, non-exclusive license to store, display and show it to other players in the Game for as long as it is part of the Game.

Every player can report another player's name, photo or team name, and block a player so that their name and photo are hidden on their own device. Reported content can be hidden automatically and is reviewed by us. We may remove or reset Player Content, stop you from uploading photos, or restrict your access to social features if you break these rules. Contact us at the address below to report anything urgent.

8. Leaderboards, Teams and Events

Leagues, races, team events and other live events are for fun. Their rewards are Virtual Items only. We may change, pause or end events, adjust results that were affected by cheating or technical errors, and update rules at any time. Some opponents and team members in the Game may be computer-controlled.

9. Changes and Availability

We continuously develop the Game and may add, change or remove content and features. We do not guarantee that the Game will always be available or free of errors, and we may discontinue it. If we discontinue a paid feature, your statutory rights remain unaffected.

10. Termination

You may stop using the Game at any time by uninstalling it. We may suspend or end your access if you seriously or repeatedly break these Terms, for example by cheating or posting prohibited Player Content.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory product liability law. For slight negligence we are liable only for breaches of essential obligations (obligations whose fulfilment makes the proper use of the Game possible and on which you may regularly rely), limited to the damage typical and foreseeable for this type of contract. Otherwise our liability is excluded to the extent permitted by law.

12. Changes to These Terms

We may update these Terms, for example when we add features or when the law changes. The "Last Updated" date shows the current version. We will inform you of significant changes in the Game. If you keep playing after changes take effect, the updated Terms apply.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.
